2. Nature of the service
NextOut is purely an information and inspiration service. The website presents travel destinations and shows indicative price guidance for flights and accommodation.
For the avoidance of doubt:
- No travel services are sold, brokered or organised.
- The provider is neither a tour operator nor a travel agent within the meaning of Sections 651a et seq. of the German Civil Code.
- No contract for any travel service is concluded via this website.
- Bookings are made exclusively on the websites of the respective partner companies and on their terms. The contracting party is solely the respective partner company.
3. Price information
All prices shown on the website are non-binding indicative values intended for orientation only.
- The figures are based on price data collected at an earlier point in time and may already be out of date when the page is viewed.
- Accommodation figures are calculated average values and do not constitute specific offers.
- They are not offers in the legal sense and not final prices within the meaning of the German Price Indication Ordinance.
- Only the price displayed by the respective partner company during the booking process is decisive. Taxes, fees, baggage charges and service charges may be added there.
There is no entitlement to the availability or bookability of any price displayed.
4. Advertising and partner links
The website is financed through partner programmes. Links to booking providers are advertising links. If a booking is made through such a link, the provider receives a commission from the partner company. This does not result in any additional cost for users.
The travel destinations shown on this website are editorially selected examples and are not the result of a user-specific search. The prices stated for them are based on price data actually collected as of a specified reference date.
The amount of any commission has no influence on this selection.

5. Availability
There is no entitlement to permanent availability of the website. The provider reserves the right to modify, restrict or discontinue the service at any time.
6. Liability
The provider is liable without limitation in cases of intent and gross negligence, as well as for injury to life, body or health. In cases of ordinary negligence, the provider is liable only for the breach of a material contractual obligation and only up to the foreseeable damage typical for this type of contract. Liability is otherwise excluded. Liability under the German Product Liability Act remains unaffected.
No warranty is given for the accuracy, completeness or timeliness of the price, weather and destination information displayed. Weather information is based on long-term average values and does not constitute a forecast.
7. Content of external websites
The website contains links to external third-party websites over whose content the provider has no influence. Responsibility for such content lies solely with the respective provider. No legal infringements were apparent at the time of linking. Permanent monitoring of linked content is not reasonable without concrete indications of an infringement. Where infringements become known, the relevant links will be removed without delay.
8. Copyright and image rights
The content and works created on this website are subject to German copyright law. Reproduction, adaptation and distribution beyond the limits of copyright law require the written consent of the provider.
The image material used is sourced from Pexels and used within the scope of the licence terms applicable there.
Should any content infringe the rights of third parties despite careful review, please send a notice to kontakt@nextout.de. Content objected to will be removed without delay following review.
9. Third-party trademarks
Names, trademarks and logos of partner companies, airlines and destinations that are mentioned are the property of their respective owners. They are named solely to describe the relevant offers and do not imply any business relationship unless expressly stated otherwise.
10. Changes to these Terms of Use
The provider may amend these Terms of Use with effect for the future where this is necessary due to changed functions of the website, technical development or a changed legal situation.
Intended changes will be announced at least 30 days before they take effect by means of a prominent notice on the website. The notice states the content of the change and the date on which it takes effect.
If you do not agree to a change, you can simply stop using the website. If you continue to use the website after the change has taken effect, this is deemed to be acceptance of the amended terms. The notice specifically draws attention to this consequence.
The version in force is published on this page together with the date on which it takes effect.
11. Applicable law
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. In relation to consumers, this choice of law applies only to the extent that it does not deprive them of the protection of mandatory provisions of the law of their country of habitual residence.
12. Severability
Should any provision of these Terms of Use be or become invalid, the validity of the remaining provisions shall remain unaffected.
